Loaned money to a family member who won't pay it back

Hello I  have lent a family member $58.000 in 12 months and now we no longer on speaking terms and I have bank statements that show it was a loan and  she is refusing to pay me back . She is a sole owner of a transport company that employs a driver to drive one of her trucks.  Where do I stand legally to recover the money I lent her in good faith.  She tells me she cant afford to pay me back but her business is up and running can I take a caveat on her business? What are my rights in recovering this money ?

Hi there. It sounds like you are in a difficult position. You may have a legal claim against your family member if you can establish that you both entered a legal contract regarding the loan of the money. A contract can exist orally and still have the same legal effect as a written one.


A contract will only exist if the parties agreed to create legal relations. This means the parties need to be serious about entering the contract such that one party will sue the other party if they fail to perform their side of the bargain.
