Hi there. The penalty in Queensland for a second drink driving offence within 5 years is a maximum fine of $7068 or 18 months in prison. This is a serious offence, and the possible outcomes for you are very serious. Because of this we recommend you seek the advice of a lawyer to ensure that you get the best possible outcome.

When you attend your hearing there is some information which will assist a decision to be made in your favour. This might include:

  • details regarding your finances in order to show the hardship which may be caused to you and your children if you were to be imprisoned. This might include a letter from your employer stating that you would loose your job if you were imprisoned.
  • Other information might include documents relating to any house payments or other financial obligations you must fulfil to support your family.
  • You may also like to include some information showing that you are not an alcoholic. This might be a report from a doctor showing you have healthy liver function.
