child custody

My son has full custody of his daughter deemed by the court after family & community services exhausted their attempts to help her mother cease her chronic drug habits and its consequences. FACS had been involved in the case since her birth. Unfortunately the mother has been unable to be rehabilitated. After years of sole custody my son has done a great job repairing her traumas. Is it possible that the mother could eventually have part custody ? Also my son is considering moving for better job opportunities can the mother stop this ? does she have that right ? she has full access to visit her daughter and has done 5 times in 3 years we live 1 hour apart presently.

Hi there. It sounds like you are having a very difficult time with your grandchild. If your son is considering moving his child to another location further away from the mother of the child, it is important that he seeks legal advice. Relocation of children is not a decision to take lightly, and it is likely that it will require the consent of a court. It is important to know that no matter the track record of the mother, a Family Court will not look kindly on your son leaving without the proper consent of the court.

Suggested way forward

Because of this, we recommend that you contact a lawyer to learn more about your son’s rights. You can get in touch with your local legal aid office, or alternatively, by pressing the "Take Action" button through LawAdvisor - which opens in early September - we can help you search for experienced lawyers and obtain fee proposals for their services. Costs for legal advice and representation will vary between providers based on experience and the scope of services.
