Can Same Sex Partners Contest a Will

People who say that they are homosexual has been on the rise since 2008, when 2.4 per cent of the population agreed with the statement: ‘I consider myself a homosexual.’ By 2014 that figure had increased significantly to 3.4 per cent.[1]The number of Australians who identify as gay or lesbian is increasing, according to a new 2015 study conducted by Roy Morgan Research.


However there are more people in gay or lesbian couples in Australia than ever before,same sex marriages performed overseas are not legally recognised here (at the time of writing).  While same sex marriages are not legally recognised in Australia, there are no limitations on same sex couples preparing a will that leaves part or all of their estate to their partner.
